Litigation in Federal Immigration Court

Government agencies usually manage immigration matters, including the United States Citizenship and Immigration Services (USCIS) or the Department of Homeland Security (DHS), which oversees U.S. Immigration Customs and Enforcement (ICE). However, some immigration matters go beyond these agencies, as they target common immigration actions or policies that harm a number of people seeking immigration benefits.

Immigration laws are federal laws, which means that challenges under those laws will need to occur in federal courts. This might include an immigration court, but some cases require filing in federal district court or even the federal circuit court of appeals. There are lengthy and complex procedures and rules that govern cases in federal court, and you always want representation from an attorney with extensive experience bringing cases in these courts.

Cases We Handle

There are different types of immigration matters that might arise in federal litigation, including:

  • APA challengesImmigration agencies are subject to the Administrative Procedure Act (APA). If we believe an agency improperly enacted rules or incorrectly applied the law in a particular case, we can challenge the agency’s actions in court under the APA.
  • Naturalization appeals – If you believe your application for U.S. citizenship and naturalization was improperly denied, we can seek a Denial of Application for Naturalization Hearing to appeal the decision.
  • Writ of Mandamus – Immigration agencies are notorious for delaying petitions without reason. If your case has been delayed unnecessarily, our team can file a writ of mandamus. This action seeks for the court to compel the agency to decide on the outcome of your immigration matter.
  • Appeals in federal circuit court – The first step to appeal an adverse immigration decision is to seek a review from the Board of Immigration Appeals (BIA). If this is unsuccessful, we can help you file an appeal with the proper federal circuit appeals court.
  • Habeas corpus – If ICE detains you or someone you love without justification or without scheduling a timely court date, we can help the matter get before an immigration judge by filing a habeas corpus petition.
