Employment-Based Immigrant Visa Wastage Round 3 

Thank you for your interest in being added to our litigation.  We are looking to assist individuals who have filed employment-based adjustment of status cases who are facing delayed adjudications and who were ready to process but skipped over in the most recent fiscal year. Plaintiffs in this case will be those who had current priority dates before 9/7/2022 and were able to be approved (i.e., they were not waiting on an I-140 to be approved or something similar), filed an adjustment of status application prior to January 1, 2022, and are now at risk of a long wait for adjusting because of retrogression in the October 2022 Visa Bulletin. We are seeking a court order that forces available visas to be used for people in this group before others who filed more recently. This case is being co-counseled by the IMMpact Litigation group of law firms.

The deadline for joining is November 28, 2022. The cost is $2025.00 per principal applicant. The fee is for the principal applicant, and all jointly filed derivative applications. We are not charging plaintiffs who paid to be in the Chakrabarti or Madhavan cases. There is no additional fee to include derivative family members who also have adjustments pending.

If you are interested in participating, please do the following:

STEP 1 – Read the FAQ and make sure you understand what the case is about, how the plaintiff fee works, and what we hope to accomplish, and who is likely to benefit from the case and who is not.

STEP 2 – Complete our engagement letter generator app. It will allow you to download the engagement letter for your records at the end and automatically send the signed agreement to us.

STEP 3 – Make your plaintiff fee payment online here.

STEP 4 – Create a declaration describing your situation and why you’re suing. You can create this using our Litigation Declaration Builder app.

Once you have done each of these things, we’ll review and make sure you’re eligible for the case. We’ll let you know if there is a problem, but if you hear nothing from us, assume you’re okay. We will send out an email automatically after you complete the engagement letter confirming you are a plaintiff in the case. We will send out a letter before we file confirming we have everything we need (or asking for anything we’re missing) and we’ll send out an additional notification once we file the lawsuit.

We hope to file within two to three weeks of the deadline for joining the case as a plaintiff.
