In this lawsuit we will be representing individuals who filed for DACA between July 2020 and July 16, 2021, who have a valid receipt notice and an unadjudicated case.
The Fifth Circuit Court of Appeals ruled more than two months ago that DACA is prohibited solely as it applied to Texas Residents. That means that USCIS now has a legal obligation to adjudicate pending DACA applications that were halted by the District Court’s Order in 2021. There are more than 90,000 of these applications. USCIS, has to date, not adjudicated these cases, even though it has a legal obligation to do so.
We are suing USCIS in a “Mass” action in a Mandamus Cause of Action. A Mandamus is a latin term that means “to demand”. We are asking a federal court judge to order USCIS to adjudicate these long pending cases in a reasonable period of time. We believe that unless forced to do so, USCIS will simply continue holding these cases in abeyance.
This case is being filed by IMMpact Litigation, a joint venture of the law firms Bless Litigation in Boston, Joseph & Hall in Denver, Kuck Baxter in Atlanta and Siskind Susser in Memphis. Step 3: Pay your fee here. We are charging $500.00 per applicant to participate in the case. The fee is a one-time charge, and we will not be billing for additional expenses and legal fees. The fee is due at the outset and is non-refundable since we will be filing the case quickly. Payment Policy: We accept credit cards and eChecks only. This, and your payment confirmation email, means that you are in our database and will be included in our lawsuit. If any information or documents are missing, we will contact you before filing the case. Otherwise, we’ll be in touch with all plaintiffs when we have filed the lawsuit with the court.
